USCIS Announces Second H-1B Lottery

USCIS will issue a second H-1B CAP lottery after not receive enough filings by June 20, 2020 to meet the annual 85,000 quota. Those not selected from the H-1B CAP lottery earlier this year will have another chance of lottery selection. Employers whose H-1B registrations are selected in the second drawing will have from August 17 to November 16, 2020, to submit their petitions.

Details are still to be release on how many additional H-1B registrations will be selected. The USCIS is expected to make an announcement on further details for the second lottery soon. The lottery winners will be selected from H-1Bs filed during the March 2020 registration period.

Based on the number of initial filings, approximately 185,000 registrations were not selected in the initial lottery. As this is the second lottery, the number of remaining registrants selected is likely to be small.

For those selected, the USCIS has provided a 90-day filing window. Petitioners may file H-1B cap petitions for selected registrations between August 17 and November 16, 2020.
