Simplifying Immigration | Rule to Increase Restrictions to the H-1B Program Will Not Take Effect.

3-minute summary of this week's immigration highlights!

Update 1

Federal agencies have released immigration priorities.

The Trump administration plans to try to restrict immigration by changing policies for the H-1B program, H-4 authorization, limiting how long international students may stay, among other restrictions. The H-1B wage increase rule was already overturned and things could change again when Biden takes office.

Update 2

Rule to increase restrictions to the H-1B program will not take effect.

Anyone else feeling the whiplash? Starting December 9, the DOL reverted to the wage data that was in effect back in October (the lower wage requirements). The new rules would have significantly restricted the H-1B program.

Update 3

Extension of Temporary Protected Status (TPS) for six countries.

TPS protects people from certain countries from deportation. In September 2020, a federal court had ruled that the Trump Administration could end TPS for El Salvador, Haiti, Nicaragua, Sudan, Nepal and Honduras. However, the court has still not issues a directive to implement the order. The good news is that because the government has not issued a directive, the government will extend TPS for these six countries until October 2021. Biden has pledged to review the TPS program and has signaled continued support.
